Termination

Voluntary Termination

A voluntary termination of employment is a termination of employment initiated by you.  A voluntary termination may occur by written resignation because of an absence from work for more than three (3) consecutive workdays without notifying Cary Academy or as a result of a failure to return to work at the expiration of an approved leave of absence or of any extension of such leave granted by Cary Academy.  An employee who is not actively working and has exhausted all Cary Academy paid benefit leave (e.g. Sick Leave, Vacation, Short-term Disability) is considered terminated effective the last day of paid leave.

Cary Academy reserves the right to accept your resignation effective immediately or as of another date before the end of the notice period. In the event of termination by either party, no further compensation is due or payable except, proportionately, that which was earned but not paid as of the date of termination and accrued vacation. If a faculty member terminates over the summer break, the termination date will retroactively be June 30 of the most recently concluded academic year.

Regardless of the length of notice given, all resigning employees should provide Cary Academy with a written notice of resignation. Cary Academy offers a financial incentive to employees who provide a separation notice of three months or more; please refer to the “Separation Notice Incentive Bonus” section in the Compensation & Benefits Guide for more detailed information.

Any part-time or full-time employee of the School who terminates employment may not return to the school as an employee in another capacity for the six months following termination unless they have the permission of the Head of School to do so (see Break In Service). 

Retirement

The retirement policy of Cary Academy is consistent with federal law.  This means that there is no established mandatory retirement age.  We ask that you notify Cary Academy of your retirement plans as early as possible.  This allows sufficient time to process any retirement benefits for which you may be eligible and to ensure a smooth transition in filling your position.

Involuntary Termination

An involuntary termination is any termination of employment initiated by Cary Academy. Involuntary termination may occur because of your unsatisfactory job performance or misconduct, or it may result from other reasons or circumstances, such as a reduction in force, a personnel problem, or any other situation in which Cary Academy determines that termination of employment is appropriate.

Break in Service

A break in service is defined as 90 consecutive calendar days from the date of termination until the date of rehire.  If rehire occurs after this 90-day period, any sick leave balance you may have earned in your prior period of employment will not be reinstated.  Your length of service to determine eligibility for employee benefits will also be measured by the rehire date.  Some benefit programs may have differing break-in-service provisions; in that case, the break-in-service provision associated with the benefit will take precedence over this general school policy. 

Final Paycheck

In case of termination of employment (whether voluntary or involuntary), your final paycheck will be issued on the regular payday for the pay period in which your termination of employment occurs.  Your final paycheck will be directly deposited according to the regular pay schedule unless you request other arrangements we can accommodate no later than 15 business days before payday.

Final pay will include (i) payment for hours worked since your last payday and (ii) payment for accrued and unused vacation time in accordance with Cary Academy’s Vacation Policy.  Final pay will be reduced by (i) required legal deductions, such as Social Security payments and state and federal income taxes; (ii) authorized deductions, such as those for coverage under the group health and dental insurance plans; (iii) any overpayment of wages due and reimbursable toCary Academy as a result of advance pay (either through payment of payroll in advance or use of paid vacation or sick time in advance of accrual), and (iv) any other amounts authorized by you or permitted by applicable law.

Return of Cary Academy’s Property

You are responsible for all Cary Academy property, materials, and written or electronic information (such as student information, including but not limited to student record information) issued to you or in your possession or control.  You must return all property of Cary Academy (e.g., keys, computers, ID, p-card, etc.) in satisfactory condition immediately upon request or termination of employment for any reason; you may not retain copies of such property, materials, or written or electronic information.  To the extent permitted by law, the School may withhold from your current or final paycheck the cost of any items not returned upon employment termination.

Unemployment Compensation

The North Carolina Employment Security Commission decides whether a terminated employee qualifies for unemployment compensation.  It is your responsibility to file a claim for benefits.  Cary Academy pays the full cost of the unemployment insurance premium in accordance with applicable federal and state requirements.
